Pool Service Agreement

This Pool Service Agreement (“Agreement”) is entered into on 2026-05-20 by and between Sunset Pool Service (“Service Provider”) and Daniel Johnson (“Client”) for pool service at 4521 Oak St, Phoenix, AZ 85016.

1. Scope of services

Service Provider will provide Full service (cleaning + chemicals) on a weekly basis. Each visit will include the following tasks:

  • Skim surface and remove debris
  • Brush walls and steps
  • Vacuum pool floor
  • Empty skimmer and pump baskets
  • Test and balance water chemistry
  • Add necessary chemicals
  • Backwash filter as needed
  • Inspect equipment for visible issues

Equipment repairs, part replacements, acid washing, tile cleaning, and any specialty services not listed above are not covered under this Agreement and will be quoted separately.

2. Service frequency and access

Service Provider will determine the day of each visit based on route efficiency. Client agrees to provide reliable property access (gate code, key, or lockbox) and to update Service Provider immediately if access changes. If Service Provider is unable to access the property on a scheduled service day due to factors in the Client's control (locked gate, aggressive pet, etc.), the visit will still be billed and rescheduling may incur an additional fee.

3. Pricing and payment

Client agrees to pay $145.00 per month for the services described above. Payment terms: Auto pay (monthly). Payments received more than 10 days past the due date will incur a late fee of 5% of the outstanding balance, minimum $10. If payment is more than 30 days past due, services may be suspended until the account is current.

4. Term and cancellation

This Agreement begins on 2026-05-20 and continues on a month-to-month basis. Either party may cancel by providing 30 days written notice (email is acceptable). Service Provider reserves the right to terminate this Agreement immediately for non payment, unsafe service conditions, or repeated access problems.

5. Liability

Service Provider is not responsible for: pre existing equipment failures, water loss from plumbing or equipment leaks not caused by Service Provider, water chemistry problems caused by external factors (heavy rain, excessive bather load, source water quality), algae growth between scheduled visits, or damage from pets or property conditions. Client is responsible for maintaining adequate water levels and informing Service Provider of any equipment issues between visits. Service Provider carries commercial general liability insurance.

6. Chemicals

Standard chemicals (chlorine, acid, algaecide) needed for routine balancing are included in the monthly fee. Specialty chemicals (phosphate remover, stabilizer, stain treatments) and chemicals required to recover from neglect or excessive bather load will be billed separately at cost plus 25% markup.

7. Equipment and repairs

Equipment inspections during routine visits are limited to visible and obvious problems. Service Provider is not a licensed equipment technician and will refer Client to a qualified specialist for diagnosis and repair. Client may engage Service Provider or a third party for repair work. Repair quotes will be provided in writing before any work begins.

8. Service guarantee

Service Provider guarantees that services will be performed professionally and that water chemistry will be balanced at the time of service. Service Provider does not guarantee water appearance between visits. If Client is unsatisfied with a specific visit, Service Provider will return within 48 hours to correct any service deficiency at no additional charge.

9. Entire agreement

This document represents the entire agreement between the parties and supersedes all prior discussions. Any changes must be in writing and signed by both parties.

Why pool service agreements matter

A pool service agreement is the most important document in your business that nobody reads until something goes wrong. Customers forget what was promised. Property managers cycle through and the new one wants to renegotiate. Disputes about chemicals, repairs, and missed visits become arguments instead of contract clauses. The agreement is the answer to all of it.

A solid contract also signals professionalism. The operator who shows up with a real service agreement and gets it signed before the first visit is the operator who gets the property manager's next three accounts.

Do I really need a contract for every customer?

Yes. A handshake works until something goes wrong. The cost of one dispute (a chemistry damage claim, a missed visit argument, a non payment) easily exceeds the time it takes to get a signed contract on every account.

What if a customer refuses to sign?

You can either decline the work or note in writing that the customer is on your standard terms. Most operators decline. The customer who refuses to sign is the customer who later disputes the bill.

Can I use the same contract for residential and commercial?

You can start with the same template, but commercial accounts often have insurance requirements, longer payment terms, and specific health code language that residential does not. Customize for commercial.

How do I handle price increases mid contract?

For month to month, give 30 to 60 day written notice before the change. For fixed term, you typically cannot change pricing until renewal. Bake annual increases into multi year agreements.

Do I include a non compete?

Most pool service operators do not. Enforcing a non compete against a former tech is expensive and often unsuccessful. A clear non solicitation clause (cannot poach customers for 12 months) is more practical.

How long should I keep signed agreements?

At least 7 years after the customer cancels. Statute of limitations on contract disputes varies by state but 7 years covers most cases.
